These Terms of Service and any terms expressly incorporated herein ("Terms") along with the Privacy Policy apply to your access to and use of this website, including the platform provided by this website (“the Website and/or “the Platform”) and constitutes an agreement between you, the User (“You” or the “the User”), and Staybot Inc. (“Staybot Platform”), and any of its associated companies, including but not limited to, Staybot SPV Proprietary Limited (“Staybot” “we” or “us”). This Website is issued and communicated by Staybot Inc. These Terms further extend not just to your use of the Website and Platform, but also any services rendered by us in respect of the Platform, including but not limited to the services we render in respect of the various products on our platform (“the Services” and the “Collective Services” when used in conjunction with the Website and the Platform). By creating an account with us and/or by using this website, You have agreed to our Terms. Our Terms are continuously updated in conjunction with improvement of the Services and compliance with the dynamic regulatory environment that governs our Services. We will notify You should our Terms change. By continuing to use the Website, our Platform and our Services, You have agreed to our updated Terms. Should You disagree with these Terms and/or do not wish to be bound to our updated terms (as applicable), You are free to discontinue using the Collective Services and may request that your account, if any, be disabled and/or deleted as required by the applicable laws and in accordance with our data policies. Please note that these Terms operate in conjunction with specific terms and conditions that regulate specific products and services, including but not limited to, your Wallet terms and conditions, your staking terms and conditions, terms and conditions for Over-the-Counter trades (OTC) and the terms and conditions for each product on our Platform (“the Specific Products and Services”). You should therefore acquaint yourself carefully not only with these Terms, but the applicable terms that apply to any Specific Service.
Limitation of Liability
To the fullest extent permitted by law, Staybot Inc., its affiliates, directors, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages—including, without limitation, loss of use, lost profits, lost data, loss of goodwill, property damage, or business interruption—arising out of or in connection with your access to or use of the Staybot mobile application, web portal, digital guest guides, or any related services (collectively, the “Services”), even if we have been advised of the possibility of such damages. In no event shall our aggregate liability to you for all claims exceed the total subscription or service fees (if any) you paid to Staybot in the twelve (12) months immediately preceding the event giving rise to the claim. The information provided through Staybot is offered “as‑is” for convenience and guidance only; Staybot is not the provider, manager, or insurer of the accommodation itself and assumes no responsibility for host or guest actions, property conditions, or third‑party services referenced in the app.
Indemnity
You agree to defend, indemnify, and hold harmless Staybot Inc. and its affiliates, as well as their respective directors, officers, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of or access to the Services; (b) your violation of these Terms of Service, any applicable law, or the rights of another person or entity; (c) any content you submit through the Services, including property descriptions, images, or reviews; or (d) your interaction with hosts, guests, or third‑party service providers arranged via or mentioned in the Staybot platform. We reserve the right, at our expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
Acceptable Use of Our Services
Staybot exists to enhance the guest experience and streamline communication between guests and hosts. You may use the Services only for lawful, legitimate purposes related to booking, staying at, or hosting short‑term rental accommodations. You agree that you will not: (i) post, transmit, or otherwise make available any content that is unlawful, defamatory, harassing, hateful, invasive of another’s privacy, obscene, fraudulent, or otherwise objectionable; (ii) impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity; (iii) attempt to probe, scan, or test the vulnerability of any Staybot system or network, or breach any security or authentication measure; (iv) use any robot, spider, scraper, or other automated means to access the Services for any purpose without our prior written consent; (v) interfere with or disrupt the integrity or performance of the Services or the data contained therein; (vi) upload or transmit viruses, worms, or any other harmful code; or (vii) encourage or enable any third party to do any of the foregoing. Violations may result in the suspension or termination of your Staybot account and legal action where appropriate.
